Privacy Policy

a. Grant of License

The products provided through the Service (the "Products") are licensed, not sold, to you. This means you are granted a limited, non-exclusive, non-transferable license to use the Licensed Application under the terms specified in this license agreement. If a Licensed Application is accompanied by a separate license agreement, the terms of that separate agreement will govern, provided that you have accepted those terms. The licensor, referred to as the “Application Provider,” retains all rights not expressly granted to you.

b. Scope of License

This license allows you to use the Licensed Application solely on an iPhone or iPod touch that you own or control, in accordance with the Usage Rules outlined in Section 9.b. of the App Store Terms and Conditions (the “Usage Rules”). The license does not permit the use of the Licensed Application on any device that you do not own or control, nor does it allow you to distribute or make the Licensed Application available over a network for simultaneous use by multiple devices. You may not rent, lease, lend, sell, redistribute, or sublicense the Licensed Application. Copying the Licensed Application, except as expressly permitted by this license and the Usage Rules, is prohibited. Decompiling, reverse engineering, disassembling, or attempting to derive the source code of the Licensed Application, including any updates, is also forbidden, unless explicitly permitted by applicable law or the licensing terms governing open-source components included with the Licensed Application. Violations of these restrictions may result in legal action. Any upgrades to the Licensed Application will be governed by the terms of this license unless accompanied by a separate license.

c. Data Collection and Use

By using the Licensed Application, you consent to the Application Provider’s collection and use of technical data and related information, including but not limited to technical details about your device, system, application software, and peripherals. This information is collected periodically to support software updates, product support, and other services related to the Licensed Application. The Application Provider may use this information in a form that does not personally identify you to enhance its products and services. Please note that the Application Provider does not store any information regarding what you type while using the Licensed Application.

d. Termination of License

This license remains in effect until terminated by either you or the Application Provider. Your rights under this license will terminate automatically without notice if you fail to comply with any terms of this license. Upon termination, you must cease all use of the Licensed Application and destroy all copies of it, whether in full or partial form.

e. Access to Services and Third-Party Materials

The Licensed Application may provide access to the Application Provider’s services and third-party services and websites (collectively, “Services”). Access to these Services may require an internet connection and acceptance of additional terms. You acknowledge that while using the Services, you may encounter content that could be offensive or objectionable. The Application Provider is not liable for such content and is not responsible for any third-party materials or websites linked from the Services. The Application Provider does not endorse or guarantee the content, accuracy, or legality of third-party materials or services and is not responsible for any damages arising from their use. Services and third-party materials may not be available in all languages or locations, and access to them is at your own risk. The Application Provider reserves the right to change, suspend, remove, or disable access to any Services at any time without notice.

f. Warranty Disclaimer

You acknowledge that using the Licensed Application is at your own risk. The Licensed Application and any related services are provided "as is" and "as available," with all faults. The Application Provider disclaims all warranties, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Application Provider does not warrant that the Licensed Application or services will meet your requirements, operate uninterrupted, or be error-free. Should the Licensed Application prove defective, you are responsible for all necessary servicing or repair.

g. Limitation of Liability

To the fullest extent permitted by law, the Application Provider shall not be liable for any incidental, special, indirect, or consequential damages, including but not limited to, loss of profits, data, or business interruption arising out of or related to your use of the Licensed Application, even if the Application Provider has been advised of the possibility of such damages. The Application Provider's total liability for all damages shall not exceed fifty dollars ($50.00). This limitation of liability may not apply in jurisdictions that do not permit such exclusions or limitations.

h. Export Control

You may not use, export, or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. Specifically, the Licensed Application may not be exported to U.S. embargoed countries or individuals on restricted lists. By using the Licensed Application, you represent and warrant that you are not located in such countries or on such lists. You also agree not to use the Licensed Application for any purposes prohibited by U.S. law, including the development or production of weapons.

i. Government End Users

The Licensed Application and related documentation are considered "Commercial Items" under U.S. federal regulations. They are licensed to U.S. Government end users as Commercial Items with rights as granted to other end users under this agreement. All rights not expressly granted are reserved.

j. Governing Law

This license agreement and your use of the Licensed Application are governed by the laws of the State of California, excluding its conflict of law principles. Your use of the Licensed Application may also be subject to other applicable local, state, national, or international laws.
